After arguing for sometime, learned Advocate for the appellant seeks permission to withdraw the appeal with liberty to reiterate the request for grant of bail, before the Sessions Court, if the trial does not commence within six months. 2.

As the request made by the learned Advocate for the appellant is reasonable, Shri T. A. Mirza, learned APP is not opposing it. However, it is submitted that because of the pandemic, the trials are not taken up expeditiously and some more time may be granted to the prosecution.

The appeal is dismissed as withdrawn with liberty to the appellant to reiterate his request for grant of bail before the Sessions Court, if trial does not commence within eight months. JUDGE JUDGE RGurnule
