Heard.

The applicants are seeking regular bail in Crime 449 of 2018 registered at Police Station, Ramnagar, Chandrapur for offence punishable under section 354, 354-D read with section 34 of the Indian Penal Code and sections 8 and 12 of the Protection of Children from Sexual Offences Act.

The accusation against the applicants is that on 25.5.2018, they accosted the victim at 5.45 a.m. when the victim was proceeding towards her tuition class on bicycle. The applicant 2 held the hand of the victim and when the victim rescued herself and attempted to proceed, she was threated with dire consequences.

The apprehension of the learned APP is that if the applicants are released on bail, they would cause annoyance to the victim and indeed physical safety of the victim may be jeopardy.

ba537of18.odt 2 to be balanced with the liberty of the applicants. This can be done by directing the applicants not to enter the corporation limits of Chandrapur city except for attending the Court hearings.

The application is allowed.

The applicants are released on bail subject to each of them furnishing personal bond of Rs. 15000/- with a solvent surety of like amount.

The applicants shall not enter the corporation limits of Chandrapur City unless they are required to attend court hearings, till the conclusion of the trial. The applicants shall furnish their address and mobile phone numbers to the Investigating Officer within 24 hours of the release on bail.

The applicant shall not tamper with the evidence nor shall attempt to influence the witnesses in any manner. JUDGE RSB
