In this petition, the order passed by the Sub-Divisional Officer(SDO), Nagpur Gramin, refusing to entertain the application made by the petitioner for conversion of land from Class-II to Class-I, is under challenge.

The learned AGP raised a preliminary objection to the maintainability of the petition and points out that under Section 247 of the Maharashtra Land Revenue Code, 1966 (in short 'The MLRC Code'), an alternate remedy is given to challenge the order passed by the SDO.

In that view of the matter, the writ petition is dismissed with liberty to file an appropriate proceedings as provided in the MLRC Code.
