14th March, 2016 This is an application for condonation of delay of 132 days in filing Second Appeal against the Judgment and decree dated 3rd November, 2014 passed by learned District judge-3, Nagpur, in Regular Civil Appeal no. 1014 of 2012.

Heard learned counsel for the appellant and learned counsel for respondent sole who strongly opposes this application.

Though this application is opposed, in my opinion, in order to have adjudication on the dispute between the

parties on merits, accepting the reasons offered in the application explaining the delay to be good and sufficient, the application is allowed and delay of 132 days caused in filing of Second Appeal is condoned. Judge |hedau|
