By this petition, the petitioner seeks a direction to the respondent no.3-Scrutiny Committee to decide the caste claim of the petitioner within a time frame. The petitioner also seeks a direction to the respondent no.1 to provisionally admit the petitioner in the first year B.D.S. Course from the academic session 2014-15 and treat the petitioner as a Scheduled Tribe candidate till her caste claim is decided.
Mrs. Dangre, the learned counsel for the respondent no.3-Committee, states that the petitioner's caste claim is referred to the Committee for verification and the same is pending. It is stated that the caste claim of the petitioner would be decided as early as possible.
In view of the statement made by the learned counsel for the respondent no.3-Committee, we dispose of the petition with a direction to the respondent no.3-Committee to decide the caste claim of the petitioner as early as possible and positively within a period of one year from the date of appearance of the petitioner before the Scrutiny Committee. The petitioner undertakes to appear before the Committee on 20.07.2015. Since the petitioner is admitted in the respondent no.1-College in pursuance of our
WP3098-14 order dated 01.07.2014, the respondent no.1-College is directed to protect the admission of the petitioner in the B.D.S. Course till the caste claim of the petitioner is decided.
Order accordingly. No costs.
With the disposal of the writ petition, C.A.W. No.1813 of 2014 stands disposed of.
