Heard learned counsel for the applicant.

Learned counsel invited my attention to paragraph 2 of the application and submitted that as the counsel was on his leg before the other Court when the present application was called and though he has instructed one of his junior colleague to attend the matter, the colleague was also busy in other Court and as such, the matter remained unattended. The learned counsel further submits that as per order of this Court dated 10-6-2015, costs of Rs. 2,000/- has already been deposited. In view of the submissions of learned counsel for the applicant and more particularly, submissions in paragraph no. 2 of the application, the application is allowed. Criminal Application (APL) No. 356/2011 be restored to its file.
