The present applicant is seeking bail in Crime No. 667/2020 registered at Police Station Mangrulpir, Dist. Washim for the offence punishable under Sections 367(2)(N) and 506 of the Indian Penal Code and Section 3 and 4 of the Protection of Children from Sexual Offences Act, 2012.

Perused the application, affidavit-in-reply filed on behalf of the State, and the charge-sheet. 4.

The case appears to be of love affair and sexual relationship on the promise of marriage. The age of the girl is around 17 years i.e. on the verge of attaining majority while the applicant is a young boy of age 27 years.

The prosecutrix lodged the F.I.R. against the present applicant as the applicant refused to marry with her.

The applicant came to be arrested on 07/05/2020. The investigation is completed and the charge-sheet is also filed.

Considering the nature of accusation no purpose would be served to keep the applicant in jail, hence, the following order :

(i) The applicant - Akash s/o Sudhakar Thombare shall be released on bail on executing Personal bond of Rs. 15,000/- with a solvent surety in the like amount.

(ii) The applicant shall not leave his local jurisdiction without prior intimation to the concerned police station.

(iii) The applicant shall not tamper with the evidence of prosecution witnesses.

(iv) The applicant to attend the concerned police station once in a month i.e. on every first Tuesday of the month between 12.00 noon and 2.00 p.m.

(v) Needless to say that the aforesaid observations are only for the purpose of deciding this application and the same shall not come in the way of the trial Court to decide the trial.
