Challenge is to the order dated 25.02.2014 passed by the Family Court Nagpur, directing payment of interim maintenance at the rate of Rs. 4000/- p. m. Effort of the learned counsel for the petitioner is to demonstrate that amount of Rs. 4000/- as awarded is on a lower side as the petitioner is required to undertake medical treatment and spend for medicines. Learned counsel is seeking to rely upon various documents in that regard. It is however stated that said documents had not been placed before the Family Court when the application below Ex. 14 was considered.

As the petitioner is seeking enhancement of amount of interim maintenance on the ground that she is required to undergo medical treatment, liberty is granted to the petitioner to

1702wp3655.14 approach Family Court for seeking enhancement of interim maintenance after placing on record documents in that regard. If such application for modification is moved, same shall be considered in accordance with law. Subject to what is stated above petition is disposed of. No costs.
