DATED : 06-06-2019 The State is challenging the order dated 07-22018 rendered by the Additional Sessions Judge, Nagpur, by and under which the application for custody under Section 17 of the Immoral Traffic (Prevention) Act is allowed and the custody of the victim girl is given to her father-non-applicant herein.

Shri Shashibhushan Wahane, learned Counsel for the non-applicant has produced on record judgment dated 09-4-2019 in Special Criminal Case 177/2018 and Special Criminal Case 266/2018, by and under which the accused is acquitted of offence punishable under Sections 366-A, 344, 372, 373 and 370-A read with Section 34 of the Indian Penal Code, Sections 4, 5 and 9 of the Immoral Traffic (Prevention) Act and Sections 6, 10 and 12 of the Protection of Children from Sexual Offences Act.

Shri T.A. Mirza, learned Additional Public Prosecutor fairly states that in view of the acquittal order, the challenge to the order impugned does not survive. 4.

Copy of the judgment of acquittal which is produced on record is marked Exhibit "A" for identification.
