The petitioner-original plaintiff has challenged the order passed by the trial Court allowing the application filed by the present respondent No.9-Dhiraj under Order I Rule 10 of the Code of Civil Procedure.

Shri N.G. Jetha, learned Advocate, who represented respondent No.9-Dhiraj, states that respondent No.9-Dhiraj has died and, therefore, the challenge raised in the petition has become redundant and the petition is rendered infructuous.

Shri D.C. Chahande, learned Advocate for the petitioner does not dispute the fact that respondent No.9Dhiraj has died. In view of the above, the petition is disposed as infructuous. In the circumstances, the parties to bear their own costs.
