The applicant is arrested on 4th June, 2017 in connection with crime registered for the offence punishable under Section 65(e) of the Maharashtra Prohibition Act and Section 188 of the Indian Penal Code.
According to the investigating agency, though sale of liquor in Chandrapur district is prohibited, huge stock of liquor worth Rs.4,00,000/- is seized from the house of the applicant.
The application is opposed on the ground that the applicant is a habitual offender and earlier also Crime No.882/2016 for similar offence is registered against him.
The applicant is in jail since 4th June, 2017. The non-applicant has not been able to show that further
2 ba523.17 custody of applicant is required for investigation. In the facts of the case, the following order is passed:
The applicant having been arrested in connection with Crime No.148/2017 registered by the non-applicant, he be released on bail on executing cash security of Rs.1,00,000/- (Rs. One Lakh) and furnishing one solvent surety in the like amount.
The application is allowed in the above terms. JUDGE Tambaskar.
