DATE : June 16, 2017 The claimants have sought permission to withdraw the amount of compensation deposited by the appellant with accrued interest.

It is submitted that respondent No.1-claimant is a house wife and respondent No.2 is pursuing her education whereas respondent No.3 is of old age suffering from other diseases. Hence for the reasons stated in the application, the claimants are permitted to withdraw 50% amount of compensation subject to filing an undertaking that in case the appeal is allowed, said amount shall be repaid with interest at such rate the Court may direct. Remaining 50% amount of compensation is permitted to be withdrawn on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial).

Civil application is allowed and disposed of. F.A. No.444 of 2016 Heard.
