Heard Shri R.M. Daga, learned Counsel for the applicant and Mrs. Mrunal Naik, learned A.P.P. for the nonapplicant/State. On going through the F.I.R., it is seen that the complainant has alleged that not only this applicant but also all the co-accused had taken active part in assaulting the deceased and that all of them had made use of sharp weapons in causing injuries to different body parts of the deceased like his chest, back portion, abdomen as well as head. However, the postmortem report discloses that the deceased had sustained only one stab wound on his chest, which was the cause of his death. It is also seen that the eye-witnesses have changed their version later on saying that the deceased was assaulted by kicks and fist blows. The complainant had stated that he had pressed the wound sustained by the deceased by his clothes in order to prevent the blood flow, but no clothes of the complainant have

2/3 been seized. There are 8 accused out of which 7 have already been granted bail. The charge-sheet has been filed. In this situation, I am of the view that no purpose would be served by keeping this applicant in jail for any longer period of time. Hence, the order :

The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond in the sum of Rs.25,000/- together with on solvent surety in the like sum on the conditions that (i) the applicant shall regularly attend the dates fixed by the Court in the matter, except when the exemption from personal appearance by law, (ii) shall cooperate with the trial Court in expeditious disposal of the case and (iii) shall not tamper with the prosecution witnesses. The application is disposed of accordingly.
