The Petitioner had filed this Writ Petition to challenge the Government Resolution dated 24 August 2018 and subsequent communication based on the Government Resolution in respect of the stipulation of passing Teachers Eligibility Test by 30 March 2019. The contention of the Petitioner is that subsequently he has passed the Teachers Eligibility Test.

It is common ground that the Government Resolution dated 24 August 2018 was challenged in various Petitions and the Division Bench of this Court at Aurangabad Bench has negated the challenge upholding the stipulation. Against the order of the Division Bench, Petitions have been filed in the Supreme Court, where order of status quo is passed. This order of status quo would enure to the benefit of the Deshmukh
wp 3022.2020.odt similarly situated teachers such as the Petitioner, even though they have not approached the Supreme Court. In light of the question of subsequent acquisition of qualification would become relevant after the decision of the Supreme Court.

In view of this clarification, it is not necessary to keep the Writ Petition pending.

Writ Petition is, accordingly, disposed of.
