The applicant, apprehending arrest in crime registered against him for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act, seeks pre-arrest bail. After hearing the learned Advocate for some time it is noticed that the applicant has not stated in the application about antecedents. In my view, it is relevant factor for considering the prayer for grant of pre-arrest bail. As relevant averment is not made in the application, it is dismissed with liberty to the applicant to file fresh application, if so advised. JUDGE Tambaskar.
