This petition takes exception to the order dated 31st January, 2024 passed by respondent no.1- the Assistant Registrar, Co-operative Society under Section 101 of the Maharashtra Co-operative Society Act, 1960. 2.

By consent of the contesting parties, the following order is passed.

The order impugned is set aside. The matter is remanded back to the respondent no.1 for deciding it afresh in accordance with the law. ii.

The parties shall appear before the respondent no.1 on 10th December, 2024.

iii.

Needless to mention that the respondent no.1 while deciding the matter afresh shall scrupulously follow the Maharashtra Co-operative Society Rules, 1961 more particularly Rule 86.

iv.

The respondent no.1 shall endeavour to decide the matter at the earliest.

The writ petition is disposed of in aforesaid terms.
