Heard.

The applicant is arrested on 1st February, 2017 in connection with Crime No.10/2017 registered for the offence punishable under Sections 302 and 201 read with Section 34 of the Indian Penal Code. Initially, after the body of deceased Kamraj was found, case of accidental death was registered, however, subsequently 5 persons are shown as accused. The name of the applicant is shown as accused after co-accused have named the applicant as one of their accomplice. According to the investigating agency, the accused and the deceased had been friends and they have duped certain persons by taking huge amount from them assuring them of securing job for them in Ordnance Factory, Bhandara.

The investigation is complete and

2 ba524.17 charge-sheet is filed on 21st April, 2017. The case of prosecution is based on circumstantial evidence. The non-applicant has not been able to point out that custody of applicant is required for further investigation. The applicant, aged about 51 years, has stated that he is not involved in any other crime / offence. Considering the facts of the case, the following order is passed:

The applicant having been arrested in connection with Crime No.10/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.50,000/- (Rs. Fifty Thousand) and furnishing two solvent sureties in the like amount.

The applicant shall attend the trial before the Sessions Court on every date unless granted exemption by the Sessions Court.

The application is allowed in the above terms. JUDGE Tambaskar.
