Hearing was conducted through video conferencing and the learned counsel agreed that the audio and visual quality was proper.

2] Heard.

3] The applicant is apprehending arrest in Crime 512/2020 registered with the Police Station Pachpaoli, Nagpur for offences punishable under section 307, 323, 504, 143, 147, 148, 149 of the Indian Penal Code. 4] The injured is one Shahabaz Khan. The incident occurred on 06.10.2020. It is alleged that five accused assaulted Shahabaz Khan which caused serious head injury and Shahabaz Khan was unconscious till admission in the hospital.

aba644.20.O.odt 5] While some accused allegedly assaulted Shahabaz Khan with fists, in so far as the applicant is concerned, he is alleged to have used a metal weapon which is described by the learned Sessions Judge as a ' fighter'.

6] The weapon is yet to be recovered.

7] Considering the role attributed to the applicant in the assault, no case is made out for exercising discretion in favour of the applicant. The application is dismissed. JUDGE NSN
