Shri S. J. Kadu, learned A.P.P. waives service of notice for the State and seeks time to file reply. However, it does not find necessary considering that one of the grounds on which this application has been made is that of parity.
On going through the first information report, it is seen that the allegations of handing out of cruelty and ill-treatment to deceased Shaherbano have been mainly made against Badrunnisa, the mother-inlaw, Sasra Khurshid, Arshya Khurshid and Fatima Khurshid, all sisters-in-law. However, these accused persons have been already granted anticipatory bail by the Additional Sessions Judge, Nagpur. The prosecution has not applied for cancellation of bail to them. In the circumstances, the case of the present
2306aba393.16.odt 2/2 applicant stands even on a better footing. The application, therefore, deserves to be allowed and it is allowed accordingly.
It is directed that in the event of arrest of the applicant in Crime No.75/2016 registered with police station Ganeshpeth, Nagpur for the offence punishable under Sections 304-B, 306 read with Section 34 of the Indian Penal Code, the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that the applicant shall attend the concerned police station for one week between 11.00 a.m. and 1.00 p.m. starting from 27/6/2016, shall cooperate with the police and shall not tamper with the prosecution witnesses.
