Ms. Khan, the learned Assistant Government Pleader appearing on behalf of the respondents, raises a preliminary objection to the tenability of the writ petition. It is stated that if the petitioner is aggrieved by the order of the City Survey Officer, the petitioner has a remedy of filing an appeal under Section 247 of the Maharashtra Land Revenue Code before the Superintendent of Land Records. It is stated that in stead of filing the appeal before the Superintendent of Land Records, a revision has been preferred before the Deputy Director of Land Records under Section 257 of the Code.

Shri Gaikwad, the learned counsel for the petitioner, states that the petitioner would avail the appropriate remedy. The learned counsel seeks permission to withdraw the writ petition.

Permission to withdraw the writ petition is granted. The writ petition is disposed of as withdrawn. The points raised in the petition are kept open.
