Shri Dharmadhikari, the learned Assistant Government Pleader for the respondents, raises a preliminary objection to the tenability of the writ petition on the ground that the petitioners have an alternate remedy of filing an appeal under the Maharashtra Land Revenue Code against the impugned order of the Tahsildar.
By upholding the preliminary objection raised on behalf of the respondents, we decline to entertain the writ petition. The learned counsel for the petitioners states at this stage that the petitioners would avail the alternate remedy and they may be permitted to withdraw the writ petition. On the aforesaid statement, the writ petition stands disposed of as withdrawn.
The points raised in the petition are, however, kept open.
