The petitioner, an academician, working with the respondent nos.4 and 5, has questioned the inaction on the part of the respondents in not investigating and enquiring into the complaint preferred by him against the recruitment process fallout which led to the selection of the respondent no.6 as the Head of the Department (Agricultural Chemistry and Soil Science). 2.

We have heard the learned counsel for the parties at length. 3.

It appears that the petitioner has also moved other proceedings including that of criminal complaint, First Information Report, etc.

At this stage, the counsel for the petitioner on instructions from the petitioner, has made a motion for withdrawal of the writ petition.

As such, the writ petition stands dismissed as withdrawn.

The learned counsel for the petitioner states that there are enquiry proceedings initiated by the respondent nos.4 and 5 and the petitioner intends to do away with all the grievances against the respondents by withdrawing all the proceedings initiated by him including that of criminal complaint and is also willing to extend all possible cooperation to the administration of the University. In this background, the counsel submits that he shall be moving before the respondent nos.4 and 5 for dropping of all the enquiry proceedings against him.

In response to the Court query and considering the approach of the petitioner to give an end to all the differences between him and the respondents by withdrawing all the proceedings, Shri A.R. Patil, learned counsel for the respondent nos.4 and 5 submits that if such application is made by the petitioner for dropping of the enquiry proceedings against him, appropriate advice would be given to the respondent nos.4 and 5 to consider the claim of the petitioner sympathetically having regard to the conduct referred to hereinabove.

As such, we accept the statement of the petitioner as regards withdrawal of all the proceedings against the respondent nos.4 and 5. We trust and expect that the respondent nos.4 and 5 would consider the request of the petitioner, in the backdrop of the aforesaid conduct and statement made before this Court, and sympathetically deal with the request of the petitioner, which he intends to move within a period of four weeks from today.

The respondent nos.4 and 5 shall communicate the decision taken by them on the application of the petitioner within a period of six weeks from the date of the application. Order accordingly. No costs.
