Kshirsagar, Advocate for petitioners Mrs. K.R. Deshpande, AGP for respondent nos. 2 and 3 Shri J.B. Kasat, Advocate for respondent no.4 CORAM : SMT. VASANTI A. NAIK AND MRS. SWAPNA JOSHI, JJ.
DATE : 27.06.2016 By this petition, the petitioners seek a direction to the respondent no.3 to include the name of the petitioner no.2 in the Centralized Admission Procedure round for admission of 60 students in the civil engineering course.
Since the petitioners were permitted by the All India Council for Technical Education to start the civil engineering course with the intake capacity of 60 students and since the affiliation of the University is not granted in favour of the petitioner no.2, it would be first necessary for the petitioners to seek the affiliation to the said course from the Amravati University. The petitioners have amended the writ petition and
2706wp3445.16.odt sought a direction against the respondent - University to take a decision in the matter of grant of affiliation to the petitioners to start the civil engineering course with intake capacity of 60 students.
Shri Kasat, the learned Counsel for the University states that before the All India Council for Technical Education granted permission to the petitioners, the University had rejected the claim of the petitioners for grant of affiliation. It is stated that the case of the petitioners was not recommended at that time. It is stated that after the permission is granted by the All India Council for Technical Education, the petitioners have made an application on 15.6.2016 and some time may be granted to decide the application.
Since the petitioners would not be entitled to admit the students this year as the Centralized Admission Procedure would be completed shortly, we dispose of the writ petition with a direction to the respondent - University to decide the application of the petitioners for grant of affiliation within a period of forty days.
Order accordingly. No costs.
JUDGE JUDGE Wadkar
