The earlier application was dismissed as withdrawn. The order dated 9.1.2018 in Criminal Application 1265 of 2017 reads thus:

"Heard Shri Zoting, the learned counsel for the applicant and Shri Pathan, the learned Additional Public Prosecutor for the State in extenso.

When the Court shown its inclination to dismiss the application, Shri Zoting, the learned counsel for the applicant submits that he has instructions to withdraw the application.

Statement accepted.

The criminal Application is dismissed as withdrawn."

There is no change in circumstances, much less significant in nature, for this Court to consider this application.

The application is dismissed.

However, in view of the submission that despite the lapse of one year from the filing of the chargesheet, the

ba541of18.odt 2 charge is not framed, the trial Court is requested to frame charge and conclude the trial expeditiously. If there is no significant progress or development within the next six months, the applicant shall be at liberty to apply for bail afresh.
