Heard.
The applicant is arrested in Crime 04 of 2017 registered at Kasansur Police Station for offence kpunishable under section 302 of the Indian Penal Code. The wife of the applicant suffered injuries on 25.2.2017 and succumbed on 3.3.2017.
The case of the prosecution is that she was hit by iron weight. Prima facie, the defence appears to be that the iron weight accidentally fell on the head of the deceased. The bail is rejected by the learned Sessions Court on the ground that considering the state of mind of the applicant, it would be unsafe to release him on bail. Such is also the apprehension expressed by the learned APP Shri T.A. Mirza.
The apprehension can be taken care of by directing that the applicant shall not enter the limits of village Reknar till the conclusion of the trial. The applicant be released on furnishing personal bond of Rs. 15,000/- with a solvent surety of like amount.
