By the impugned order, the learned District Judge has deferred the hearing of the application (Exh.9) filed by the petitioner and decision on it, by recording that the application (Exh.9) will be decided along with appeal. I find that the course adopted by the learned District Judge is permissible in law. The learned Advocate for the petitioner has not been able to point out that it was necessary for the learned District Judge to decide the application (Exh.9) at this stage and the decision on the application should not have been deferred.

In view of the above, I see no reason to interfere with the impugned order.

The writ petition is dismissed. No costs.
