It is seen from the statement of the prosecutrix recorded under Section 164 of Criminal Procedure Code that the prosecutrix prima-facie, had attained sufficient majority of understanding the consequences of her behaviour. It is also in addition to the fact that the ossification test report shows that the age of the prosecutrix was between 17 years and 19 years at the relevant time. That apart, the prosecutrix has not attributed anything incriminating to the present applicant when her statement under Section 164 Cri.P.C. was recorded. The chargesheet has been filed. Therefore, this would be a fit case for grant of bail. Hence, the order.

The application is allowed and it is directed that the applicant be released on bail on

Bond in the sum of Rs.15,000/- with one solvent surety in the like amount on the conditions that he shall regularly attend the Court on the dates fixed in the case against him, shall cooperate the Court in expeditious disposal of the case and shall not tamper with the prosecution witnesses.
