Heard Shri R.V. Shiralkar, learned counsel for the petitioner and Shri N.H. Joshi, learned AGP for the respondents.

The respondents are not accepting status of the petitioner as Government servant. If the status is accepted, the petitioner claims other benefits, after his superannuation, against the State Government. 3.

Thus, remedy of approaching Maharashtra Administrative Tribunal under Section 19 of the Maharashtra Administrative Tribunals Act, 1985, is available to the petitioner.

Hence, without observing anything on merits of the controversy and with liberty to the petitioner to exhaust that remedy, we dispose of this writ petition. No order as to costs.
