DATE : 02/09/2021 Section 16 (1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, provides for an appeal against the order passed under Section 5 of the said Act. In view of which, Shri Mishra, learned counsel for the petitioner, seeks permission to withdraw the petition with liberty to file an appeal before the Appellate Tribunal under Section 16(1) of the said Act. He, however, requests for expeditious decision of the appeal, considering that the petitioner is a senior citizen. The learned counsel for the petitioner also submits that such an appeal shall be filed within one week from today.

In case, such an appeal is filed, the Appellate Tribunal is directed to decide the same within a period of one month from the date of its filing, in consonance with the provisions of Section 16(6) of the Act of 2007. 3.

The petition is dismissed as withdrawn with liberty as prayed for.
