DATE : 30.08.2016 By this writ petition, the petitioner has sought a direction against the respondents to protect the education of the petitioner in the Bachelor of Technology (Chemical Engineering) course.
According to the petitioner, the petitioner has filed the instant petition as the Scrutiny Committee at Nagpur has refused to verify the caste claim of the petitioner. During the pendency of the writ petition, in view of the interim order passed by this Court, the petitioner has secured the caste certificate from a competent authority from the Madhya Pradesh and has submitted the caste certificate to the Scrutiny Committee at Seoni for verification. It is stated that the caste claim of the petitioner is pending before the Scrutiny Committee at Seoni. Since it is stated that the petitioner has completed his education in the Bachelor of Technology (Chemical Engineering)
course and since the caste claim of the petitioner is pending before the Scrutiny Committee at Seoni, this Court would not be in a position to direct the Scrutiny Committee at Seoni to decide the caste claim of the petitioner within a time frame. It would be necessary for the petitioner to seek such direction, if necessary, from the appropriate Court or forum in Madhya Pradesh. In the circumstances of the case, we dispose of the writ petition with no order as to costs.
