DATED : APRIL 21, 2016 Adv. Quazi for petitioner submits that though he could have carried out the amendment in the light of material which petitioner has received thereafter, it appears that certain plots have been regularized by Nagpur Improvement Trust. He, therefore, states that on the basis of that material, a comprehensive petition needs to be filed. According to him, instead of amending petition, a fresh petition raising all challenges is more appropriate.

Adv. Chhabra for respondent no.3 does not have any objection if petition is disposed of as withdrawn. However, he is opposing grant of liberty. This Court has not admitted the petition

In this situation, as challenge has not been looked into on merits, we grant liberty as sought for by Adv. Quazi.

The petition is accordingly disposed of as withdrawn with liberty to file a comprehensive petition raising all available challenges.
