DATED : 10-6-2015 Heard learned counsel for the rival parties.
Looking to the nature of the dispute projected before this Court by the learned counsel for the parties who have argued for some time, I think in view of the impugned order which is practically a non-speaking order, the applicants should be relegated to the remedy of revision before the Sessions Court since the same has not been availed of. That being so, I make the following order.
ORDER
(i) Criminal Application (APL) No. 409/2014 is disposed of reserving the liberty in favour of the applicants to file revision before the Sessions Court within a period of four weeks from today.
(ii) Counsel for the respondent submits that he would not object to the revision application being barred by limitation.
(iii) After revision application is filed, counsel for respondent to take notice before the Sessions court in order to avoid the formality of service of notice.
(iv) Mr. Chavan, learned counsel undertakes to supply copies and communicate the further date.
2 apl409.14 (v) If revision application is filed before the Sessions Court, same shall be decided as expeditiously as possible and within a period of six months from the date of filing of revision application.
(vi) Interim order made by this Court shall continue to operate till disposal of the revision application. JUDGE wasnik
