By this writ petition, the petitioners seek a direction against the respondent nos.1 to 3 to seize the records of the respondent no.5 under the provisions of Section 80 of the Maharashtra Cooperative Societies Act, 1960. Some other ancillary prayers are also made in the writ petition.
Shri Joshi, the learned Assistant Government Pleader appearing on behalf of the respondent nos.1 to 3 has tendered an affidavit-in-reply of the aforesaid respondents in the court, today. The same is accepted on record. It is stated in paragraph 4 of the reply that the record from Chankapur colony is already seized and the record from Wanadongri, Hingna is in the process of being seized. It is stated that the copy of the panchnama, dated 08.11.2016 in respect of the seizure of the record from Chankapur is annexed to the reply. It appears from the statements made in the affidavit-in-reply that the respondent nos.1 to 3 are taking appropriate action in the matter of seizure of the record.
WP4547-16 Hence, by accepting the statements made on behalf of the respondent nos.1 to 3 in paragraph 4 of the affidavit-in-reply, we dispose of the writ petition with no order as to costs. The respondent nos.1 to 3 may make an endeavour to complete the process as early as possible. Order accordingly. No costs.
