The applicant, apprehending arrest in crime registered against him for the offences punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act, 1949 has sought pre-arrest bail.

The name of the applicant does not appear in the first information report. The vehicle from which the liquor is seized does not belong to the applicant. The non-applicant has not been able to show that custodial interrogation of the applicant is required for further investigation. In the facts of the case, the order passed on 15th June, 2017 granting protection to the applicant is confirmed. The application is allowed in the above terms. JUDGE RRaut..
