The contention is that as per the clauses of the brochure issued by the respondent No.2 regarding allotment of dealership and retail outlet, after preliminary selection of a person as dealer any short fall is found in the land offered by the dealer, one opportunity is required to be given to the dealer, but that opportunity has not been given to the petitioner.

At this stage, the learned counsel for the petitioner on instructions, seeks leave of this Court to KOLHE
2 / 2 11-WP 3303.2021 withdraw the petition with liberty to make representation offering alternate land to the respondents. He also submits that if such representation is made, appropriate direction be issued to the respondents for its expeditious decision in accordance with law.

In view of above, leave to withdraw the petition with liberty as prayed for is granted, subject to the condition that representation offering alternate land to the respondents shall be made within three days from the date of the order and if it is so made, same shall be decided in accordance with law by the respondents, within one week of the date of representation. 5.
Writ Petition is disposed of accordingly. No costs.
