This application is moved by respondent No.1(b)/claimant for withdrawal of amount deposited by the appellant/VIDC.

The application is strongly opposed by the appellant/VIDC by filing its preliminary objection. 4.

After hearing learned counsel Shri J.J.Chandurkar for the appellant, learned counsel Shri M.P.Kariya for the claimant, and learned Assistant Government Pleader Shri M.A.Kadu for respondent Nos.5 and 6 and after having perused the preliminary objection, I find substance in the preliminary objection raised by the appellant/VIDC.

In this view of the matter, when the Court was about to reject the application, learned counsel for the .....2/-

caf1875.21 7 claimant submitted that he wishes to withdraw the application with liberty to claimants to file an appropriate application.

The prayer is accepted.
