Heard learned counsel for the applicant and learned APP for the respondent/State.
Major part of the investigation is over, as seen from the case diary and the illicit liquor has also been seized. Learned counsel for the applicant states that presently only three criminal cases are pending against the applicant and in none of them any offence punishable under the provisions of Maharashtra Prohibition Act is involved. Learned APP could not show to me that any other criminal offence wherein offence under the said Act has been registered, is pending against the present applicant. In these circumstances, the applicant, in my view, deserves to be released on bail.
The application is allowed and it is directed that the applicant be released on bail on his furnishing a P.R. Bond of Rs.20,000/- together with one solvent surety in like sum on
conditions that the applicant shall regularly attend the dates in the case field against him, shall not indulge in criminal behaviour and shall co-operate with the Court in expeditious disposal of the case. Application is allowed and disposed of accordingly. Judge /TA/
