Heard.

The applicant is in custody since 19.1.2018 in connection with Crime 16 of 2018 registered with Parseoni Police Station for offences punishable under section 376, 302 and 201 of the Indian Penal Code.

The dead body of one Smt. Gitabai Dhore was found in a highly decomposed condition on 13.1.2018. Initially, the First Information Report was registered against "unknown person". During the investigation, the applicant came to be arrested. The investigation is complete and the chargesheet is filed.

The prosecution case is concededly predicated on circumstantial evidence. Two circumstances are brought to my notice by the learned APP. The first is the statement of Smt. Rasila Burde which is to the effect that she met the applicant - accused at 3.00 p.m. or thereabout. The applicant was running and was apparently frightened which prompted Smt. Rasila Burde to ask him why he was running

ba548of18.odt 2 and whether the police have arrived and the response was allegedly in the affirmative. The other statement is of one Ravindra Thakur which is to the effect that on 7.1.2018 between 1.00 p.m. and 1.30 p.m., the applicant requested him to look after his goats and told Ravindra that he is going home and would return.

In the light of the material on record, the application shall have to be allowed.

The application is allowed.

The applicant be released on furnishing personal bond of Rs. 15,000/- with a solvent surety of like amount. The applicant shall not tamper with the evidence nor shall attempt to influence the witnesses in any manner. JUDGE RSB
