Heard Shri Y.V. Nayyar, learned Counsel for the applicants, Shri N.B. Jawade, learned A.P.P. for non-applicant no.1 and Shri S.P. Sonwane, learned Counsel for non-applicant no.3. Perused papers.

Learned A.P.P. appearing on behalf of non-applicant no.1 has pointed out that investigation reveals dispossession on 25.02.2016. There are eye witnesses. Learned counsel appearing for non-applicant no.2 states that there

are photographs which shows dispossession.

The applicants before this Court claim that possession was handed over to them, but, are not in a position to prove the same by placing on record any document to support that contention. Only submission is, applicants are in possession. According to non-applicants, applicants have forcibly dispossessed the non-applicant no.2. 4.

As the charge sheet was filed even before this Court issued restraining orders in the matter, we find no case is made out warranting interference in extra ordinary jurisdiction. However, keeping all rival contentions open, we dispose of the present Criminal Application. No costs.
