By present application, the applicant is seeking condonation of delay of 40 days in filing the Appeal against the order of acquittal dated 31.01.2022 passed by learned Judicial Magistrate, First Class, Maregaon in Regular Cri. Case No.70/2019.

Learned counsel appearing for Respondent has opposed the application.

However, the delay being merely of 40 days and further for the reasons stated in para no. (5) of the Application and in the interest of justice, the Application is allowed. The delay of 40 days caused in filing the present appeal is hereby condoned. The Appeal be registered. List the Appeal on 24.01.2023.
