CRIMINAL APPLICATION (APPA) NO.456/2025:

This is an application for suspension of sentence and releasing the appellant on bail.

The appellant is convicted for the offences punishable under Sections 7, 13 (1)(d) read with Section 13

(2) of the Prevention of Corruption Act, vide judgment and order dated 29.04.2025 passed by the learned Special Judge (Prevention of Corruption Act) and Additional Sessions Judge-1, Nagpur in Special Case No.07/2002. After convicting the appellant as above, the learned Special Judge has suspended the sentence till the end of period of limitation or the filing of the appeal. The appellant is 77

apeal256.25.O.odt years old. The sentence imposed is of three years. Having regard to the pendency of the appeal, the appeal is not likely to be heard in the near future. In that view of the matter, I am inclined to suspend the sentence and release the appellant on bail.

O R D E R

(i) The appellant Devidas s/o Jagannath Joshi be released on bail on executing P.R. bond in the sum of Rs.25,000/- with one solvent surety in the like amount.

(ii) The execution of the sentence is suspended till disposal of the appeal.
