The main relief sought in the writ petition is with regard to consider the grant of benefits of pension to the writ petitioner in terms of earlier pension scheme and not the proposed new scheme brought in by the respondentauthorities. Though she claims that she was appointed way back in 1997, approval to the post was with effect from 2008 onwards. In order to fall within eligibility criteria to claim pension under the erstwhile scheme, number of years of service is also relevant factor and since the petitioner is retiring in the year 2019, she may not be able to get pension since the approval of post or service is only from 2008. In that view of the matter, the petitioner may have to approach this Court with better particulars and better reliefs. Hence, we permit the petitioner to withdraw the writ petition reserving liberty to file fresh comprehensive petition.
