The applicants and five others are implicated in the Crime 705/2020 registered with Police Station Balapur, District Akola for offence punishable under sections 143, 147, 148, 149, 324, 326, 307 and 506 of the Indian Penal Code.

It is alleged that the assault, in which as many as four members of the complainant's family, including the complainant, suffered injuries is a fall out of dispute touching the right of way.

The role attributed to the applicant is that he assaulted the informant Santosh with stick, on the thigh. However, there is no corresponding injury or mark on the

Considering the nature of the accusations, and particularly the fact that if the pre-arrest protection is confirmed, the investigation is not likely to be adversely affected, the interim protection granted vide order dated 02.11.2020 is made absolute with the only modification that till the charge-sheet is filed, the applicant shall attend the concerned police station as and when required by the Investigating Officer.
