The petitioner has challenged the order passed by the Industrial Court dismissing her complaint and consequently, rejecting her claim for re-employment as per Section 25H of the Industrial Disputes Act.

In response to the notice issued by this Court, the respondents 1 and 2 have filed an affidavit sworn on 22nd

2 wp4115.14 January, 2016, in paragraph no.4 of which it is stated that the decision is taken by the respondent no.4 that whenever there will be an advertisement for the post for which the petitioner is making her claim, the entitlement of petitioner to be employed will be considered by relaxing the condition of age limit. The learned advocate for the petitioner, on instructions, states that the petitioner is satisfied with the submission made by the respondents 1 and 2 on oath.

The learned advocate for the petitioner, on instructions, further states that in view of the submission made on behalf of the respondents 1 and 2 before this Court on oath, the petitioner does not want to prosecute the petition further and seeks permissions to withdraw the petition.

The petition is disposed as withdrawn, recording the submission made on behalf of the respondents 1 and 2 on oath, as stated above. No costs.
