Heard.

The applicant, apprehending arrest in crime registered against him for the offence punishable under Section 307 and 34 of the Indian Penal Code, has sought prearrest bail. The crime is registered against the applicant on the accusations that the applicant who is vegetable vendor assaulted the victim who is also vegetable vendor because of the dispute regarding the place/ space to be occupied by them in the market area.

The applicant claims that he is selling the vegetables and is not involved in any other crime/ offence. These facts are not controverted by the non-applicant. The non-applicant has not been able to show that the custody of the applicant is required for further investigation.

2 aba409.17 Considering the facts of the case and the nature of accusations against the applicant, in my view, the applicant is entitled for pre-arrest bail.

Hence, the following order :

In the event of arrest in Crime registered by the non-applicant vide F.I.R. No.241 of 2017, the applicant be released on bail on furnishing P.R. bond for Rs.Ten Thousand and one solvent surety in the like amount.
