DATE : 5 th FEBRUARY, 2020 01] The learned Advocate for respondent Nos.1 to 4 submits on instructions that they have a copy of a letter written by the petitioner, dated 22/11/2016, which was received by the respondents on 28/11/2016, in their record. He further tenders a copy of the confidential letter written by the Chief Engineer, C.S.T.P.S., Chandrapur, dated 05/12/2016 addressed to the Chief General Manager (HR), M.S.P.G.C.L., Mumbai. Based on these two documents, he submits that the respondents desire to withdraw the impugned notice, since it has not been properly worded. They would issue a fresh notice to the petitioner. 02] The learned Advocate for the petitioner submits that if such fresh notice is issued, his contentions with reference to the same may be kept open.

wp.3849.17 2/2 03] We have taken on record the copy of the letter issued by the petitioner, dated 22/11/2016, which is marked as "X-1". We also take on record the copy of the letter, dated 05/12/2016, issued by the Chief Engineer and which is marked as "X-2" for identification.

04] Considering the above, this petition is disposed off by permitting the respondents to withdraw the impugned notice with liberty to issue a fresh notice.
