I was not inclined to consider the application for grant of bail, at this stage.

The learned Senior Counsel for the applicant Mr. S. P. Dharmadhikari submits that instead of rendering an elaborate order the applicant may be permitted to withdraw the application with liberty to approach this Court again if there is no significant progress in the trial in the next six months.

The request is reasonable.

The application is disposed of as withdrawn.

The learned trial Judge is requested to frame the charge, if not already framed, within the next thirty days.

If there is no significant progress in the trial in the next six months, the applicant shall be at liberty to approach this Court again for bail.

The liberty is subject to two conditions. The first is that this order shall be brought to the notice of the learned trial Judge by the applicant within the next seven days and the second condition is that the delay in trial, if any, shall not be attributable to the applicant - accused. JUDGE NSN
