The applicant is arrested on 29th November, 2016 in crime registered against him for the offence punishable under Sections 363, 376(II)(f) of the Indian Penal Code and Sections 4 and 12 of the Protection of Children from Sexual Offences Act. The crime is registered on the complaint of Kamaljeet Kaur, who claims to be guardian of the victim, aged about 16 years. The accusations against the applicant are that he has sexually exploited to the victim. The investigation is complete and charge-sheet is filed on 28.02.2017. The non-applicant has not been able to show that the custody of the applicant is required for further investigation. Considering the nature of the accusations against the applicant, facts of the case, medical examination report and fact that the Investigating Agency has not recorded statement of the victim as required by Section 24 of the Protection of Children from Sexual Offences Act, the following order is passed :

The applicant having been arrested in Crime

2 ba533.17 No.241 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond of Rs.20,000/- and one solvent surety in the like amount.
