The State Of Maharashtra Thr. The Collector Amravati And Others v. Dr. Vasantrao Punjaji Lokhande
F.A.St.12701/2016
IN THE HIGH COURT OF JUDICATURE AT BOMBAY,
BENCH AT NAGPUR FIRST APPEAL ST.NO.12701 OF 2016 WITH CIVIL APPLICATION NO.3390 OF 2016 The State of Maharashtra through the Collector, Amravati and ors.
..Applicants
Versus
Dr. Vasantrao Punjaji Lokhande ..Respondent Mr M.A. Kadu, A.G.P. for applicants CORAM : N.W. SAMBRE, J.
DATE : 20th April 2017 PER COURT 1.
There is delay of 945 days in preferring the present appeal by the State Government.
2.
Though the delay is sought to be explained by the applicants/appellants by citing the issue of time consumed in establishing contact with the office of the Joint Secretary, Law and Judiciary Department and the office of the Government Pleader, High Court, Nagpur, however, upon perusal of application, same reflects lethargic approach on the part of concerned authority, which is writ at large as no serious efforts were made to file the proceedings. 3.
Apart from above, with the assistance of learned Assistant Government Pleader, I have examined the judgment of the reference Court. It is required to be noted that after the issues were framed at
F.A.St.12701/2016 Exh.14, the enhancement was awarded for the land in question and for the lemon and sweet lime trees.
4.
The claimants P.W.1 and P.W.2 were examined in support of the claim. Evidence in support of the age of the trees, the yield capacity is also appreciated. No case for interference is made out. Appeal fails, stands dismissed. Civil Application for condonation of delay stands dismissed.
