By this writ petition, the petitioner seeks to release him on emergency parole leave.

Heard learned counsel Mrs.Sonali Saware appointed to represent the petitioner by the High Court Legal Services Sub Committee at Nagpur and learned Additional Public Prosecutor Mrs.N.R.Tripathi for the State. 3.

The State has filed its reply. In the reply, it is stated that the petitioner is convicted for offences punishable under Sections 4 and 10 of the Protection of Children from Sexual Offences Act, 2012. It is also stated that since the petitioner is convicted under the POCSO Act, he is not entitled for grant of parole leave.

The issue involved in the present writ petition is no longer res integra in view of an authoritative pronouncement of the full bench of this Court in the case of .....2/-

No case is made out. The criminal writ petition is dismissed and disposed of as such.

Fees payable to learned counsel Mrs.Sonali Saware, who is appointed for the petitioner by the High Court Legal Services Sub Committee at Nagpur, are quantified at Rs.2500/- towards her professional charges.
